USCIS Ends EAD Auto-Extensions

The Department of Homeland Security (DHS) has issued an interim final rule ending the automatic extension of Employment Authorization Documents (EADs) for most renewal applicants, effective October 30, 2025. Only limited exceptions—such as Temporary Protected Status (TPS)-related extensions and STEM OPT extensions—will remain. 

Work Authorization

The policy aims to enhance security by requiring more frequent background checks on individuals seeking work authorization in the U.S. USCIS emphasizes that employment in the United States is a privilege, not a right, and encourages applicants to file renewal requests up to 180 days before their EADs expire to avoid work interruptions. Existing automatic extensions granted before October 30, 2025, will not be affected. So, if you have a work permit, please plan to renew it 6 months before it expires.

New $1,000 Parole Fee

The Department of Homeland Security (DHS) has announced a new $1,000 immigration parole fee, established under the H.R. 1 Reconciliation Bill, effective October 16, 2025, with annual inflation adjustments. This fee applies to individuals being paroled or re-paroled into the United States, unless they qualify for an exception outlined in the Federal Register notice.

Thankfully, anyone who has advance parole based on pending I-485 is NOT required to pay the parole fee.

U.S. Citizenship and Immigration Services (USCIS) will notify applicants when payment is required, providing instructions and a deadline. Parole will not be granted until the fee is paid as directed. Applicants should not submit the fee with Form I-131, as it will be collected upon parole approval. The Federal Register notice provides further details on fee applicability, exceptions, and enforcement procedures.

Non-Immigrant Visas Must be Processed in Country of Citizenship or Residency

Starting in October 2025, the Department of State has instructed applicants for U.S. nonimmigrant visas (NIV) to schedule their visa interview appointments at the U.S. Embassy or Consulate in their country of nationality or residence. Nationals of countries where the U.S. government is not conducting routine nonimmigrant visa operations must apply at the designated embassy or consulate, unless their residence is elsewhere.  Most notably, citizens of Russia are designated to process visas in Warsaw, Poland and Almaty, Kazakhstan.

O-1’s for a chemical engineer, an agronomist, a CEO/Founder, a product manager, and actor, an animator, an architectural designer, 5 cinematographers, a composer, a content creator, a creative director, a director, a director/producer, a director/script supervisor, a director/editor, 4 editors, a fashion designer a host/actor, a jewelry designer, a model, a motion designer/animator a multimedia 3D digital artist, a musician, 5 producers, 3 production designers, a puppeteer/stage manager, a singer, a singer/performer, a tattoo artist, a tour manager, a band, and a TV crew of 68 from Ecuador, Brazil, China, India, South Africa, UK, Taiwan, Indonesia, Canada, South Korea, Mexico, Australia, Italy, Vietnam, and Germany

We also obtained EB-1 I-140 approvals for an artist, an optical & AI computing expert, and a sound engineer from Israel, China, and Georgia. EB-1 green cards were approved for a dialogue editor/mix technician, a lead technology product manager, and a music designer (and their spouses) from Taiwan, India, and Hong Kong.

Last but not least, we were able to obtain green cards based on marriage to a US citizen for citizens of Australia and Canada.
