USCIS Updates Policy Guidance for International Students

USCIS has issued new guidance that consolidates information from various sources, and clarifies some frequently raised issues with F & M visas. The new guidance addresses many important questions such as the tension between students having a foreign residence that they do not intend to abandon and being the beneficiary of a permanent labor certification application or immigrant visa petition; and how F students seeking an extension of optional practical training (OPT) based on their degree in a science, technology, engineering, and mathematics (STEM) field may be employed by startup companies, and many other issues F and M students face.

EB-1 Priority Dates

EB-1 priority dates advanced significantly for citizens of India in January 2024, with the priority date jumping from Dec 1, 2017 to Sept 1, 2020. For citizens of China the EB-1 priority date also advanced from Feb 15, 2022 to July 1, 2022.

In the months of November and December, we have congratulated a Greek tattoo artist, a Mexican actor, Russian influencer and model, a Spanish architect, a Colombian visual effects artist, a Chinese producer, a British photographer/musician/producer, a Korean animator, a Swiss actor, a Chinese Content producer, two Russian photographers, a Ukranian photographer, a Canadian publicist, a Russian Ice Cross Racer, a Canadian Producer, a Colombian Art Director, a Vietnamese singer, a Chinese animator, and a Chinese Cinematographer on their O-1 and  EB-1 approvals!
